Can I declare a chapter 7 bankruptcy?

I have approximately $40,000.00 in credit card debt. We were able to pay minimum payments until 7 months ago. That’s when my brother and his classmate were murdered and 6 other family and friends wounded at a children’s birthday party. I had to charge for my trip to the Philippines, the hospital, the funeral parlor and cemetery. That’s when it got to about 40k. We believe the shooters made a mistake and shot the wrong house. Three years earlier I also had to travel to the Philippines to pay for the same things for my 16 year old niece who died in cheer leading practice. I have not worked in over 4 years. We live off my husbands federal disability income which is non-taxable and not attachable. Can I declare a chapter 7 bankruptcy? We live in California. Thank you.
